These App-specific Terms of Service are self-hosted by our Server: https://api-net-diagnotor.zinben.net/legal/terms-of-service.en.html. App Store Terms of Use (EULA) link target: this URL may also be used as the custom EULA link in App Store Connect (alongside the Privacy Policy URL), consistent with Apple Guideline 3.1.2. The legal entity name and the company-wide master Terms of Service URL are rendered in the "Company-Level Legal Documents" section at the bottom of this page (single source of truth, injected from AppConfig.Legal.companyTermsOfServiceUrl by LegalDocRenderer).

1. Acceptance

By downloading, installing, or using Net-Diagnotor (the "App"), you confirm you have read, understood, and agree to these Terms. If you do not agree, do not use the App.

2. Service

The App offers network diagnostics, performance testing, Discovery reporting, and community features for individual users. Available features may differ across distribution channels (App Store, Google Play, Huawei AppGallery, Chinese stores) and versions.

3. Account, Membership & One-Time Purchases

• Account: most features work without registration. Discovery / feedback may use a device ID as an anonymous identifier. In Membership, you may optionally sign in with an OpenDev account (OAuth / phone / email) to sync entitlements across devices. OpenDev accounts do not replace Apple / Google / Huawei store accounts.
• Membership subscriptions (Basic / Pro):
  • Store channels: via Apple StoreKit / Google Play Billing / Huawei IAP (Android Huawei APK and HarmonyOS NEXT Ark build);
  • Official APK / Desktop: via the Server-hosted OpenDev web checkout (system browser or in-app WebView), alongside store IAP;
  • tiers, prices, renewal, and refunds follow the relevant store or checkout UI; we do not store card numbers.
• Rewarded Basic: some surfaces (including CN mobile portal Web) grant short-term Basic days after rewarded video ads (caps as shown in UI) — not an auto-renewing subscription.
• One-time purchases (such as tips) may be available via store IAP or OpenDev web checkout on official / Desktop builds. These are not auto-renewing subscriptions.
• When a subscription ends, is cancelled, or is refunded, the related membership benefits (including enhanced diagnostics, ad-free experience, and other subscription-only entitlements) are automatically suspended.

4. Acceptable Use

You agree not to:

1. Use the App for unlawful purposes or to infringe third-party rights;
2. Submit content that is illegal, obscene, violent, harassing, defamatory, or false;
3. Interfere with, attack, or circumvent the security of the App or its backends;
4. Reverse-engineer, crack, sell, or redistribute the App's binaries or assets;
5. Use the App to scan, attack, or probe systems you are not authorized to access.

We may restrict or terminate accounts violating the above and cooperate with authorities as required.

5. Intellectual Property

All code, UI designs, copy, icons, and audio in the App are owned by the Zinben team and its licensors and protected by copyright, trademark, and international treaties. No commercial use without written permission.

Third-party SDKs and open-source components are licensed under their respective licenses; see https://api-net-diagnotor.zinben.net/legal/sdk-list.html.

6. Disclaimer

• Diagnostic results are advisory; we do not guarantee the quality, availability, or security of any network service.
• We are not liable for outages caused by force majeure, third-party SDK failures, or ISP issues; we will assist within reason but disclaim indirect losses.
• To the maximum extent permitted by law, we disclaim liability for any indirect, incidental, special, or consequential damages.

7. Privacy

Our handling of personal data is described in the Privacy Policy.

8. Changes & Termination

• We may revise these Terms; material changes will be notified in-app or by re-showing the first-launch consent screen.
• You may stop using and delete the App at any time; we may also suspend service for cause.

9. Governing Law

These Terms are governed by the laws of the People's Republic of China. Disputes will be settled by friendly consultation; if unresolved, submitted to the People's Court of Tianhe District, Guangzhou (where the operating entity is domiciled). Users in other jurisdictions retain mandatory rights granted by their local law.

10. Relationship with the Company-Wide Master Terms of Service

Net-Diagnotor is operated by Zinben. These app-specific Terms are the specific application of the company-wide master Terms of Service to Net-Diagnotor. Where they do not conflict, these Terms apply first; for matters not covered here, the company-wide master Terms apply.

The legal entity name and master Terms of Service URL are rendered in the "Company-Level Legal Documents" section below. The backend can adjust them via the LEGAL_COMPANY_NAME / LEGAL_COMPANY_TERMS_URL environment variables without editing this Markdown file.
